No moot point: Drake Law students learn from coachFebruary 4, 2004

Four Drake University Law School students will be heading to court to start off their spring break. However, instead of coming under suspicion or serving on a jury, these students will be competing in the Giles Sutherland Rich Memorial Moot Court Competition, sponsored by the American Intellectual Property Law Association.Under the direction of intellectual property attorney Wendy K. Marsh, member of McKee, Voorhees & Sease, P.L.C. of Des Moines, the students will compete against their peers from regional law schools March 19-21, 2004, in Chicago. Paired in teams of two, Marsh explains the students work together to write briefs for both the appellant and the appellee sides of the case. The briefs are then submitted and practice in presenting oral arguments begins. From the middle of February until the time of competition, Marsh will meet with the students to critique their presentation of the subject matter, applicable law, and ability to respond to judicial questions. ‘Ed (Sease) coached the team for the past 8 or 9 years and decided to pass the reigns, , so I took over,’ Marsh says. ‘It’s a way for me to stay involved with Drake University, and I really enjoy working with the students. It’s fun to watch their writing and oral argument skills improve. If the (students) have any interest in doing litigation this is very beneficial . If they do well, it’s also a real honor for Drake.’This year the fictional case focuses on issues of trade dress and patent infringement in the case of Moo! Cream Inc. vs. Piggy’s Inc. If either of Marsh’s two teams wins the regional competition, they will advance to national competition in Washington, D.C. April 14-16, 2004.
